In Ethics Trial, It Is As If Setnov Reads Legal Defense: Observer
Setya Novanto (Photo: MI/Moh Irfan), Jakarta: Constitutional law observer Refly Harun assessed the defense of the Speaker of the House of Representatives (DPR) Setya Novanto in an ethical hearing at the Board's Honor Tribunal (MKD) DPR was a little bit off with the intention of the tribunal in seeking his appearance. Reply mentioned that the defense delivered by the man closely known as Setnov is similar to a legal defense (pledoi).
"He is like reading a legal defense, a defense on which it was prepared by his lawyer, definitely by a lawyer, because it contains legal terms," said Refly to Metro TV, Monday (12/7/2105).
Refly felt weird with the defense conveyed by the Golkar Party politician. Setnov, as the accused in the ethical hearing, should only answer the questions of the MKD members to confirm and verify the evidence obtained by the tribunal.
"Not directly providing the chance for him to read out a defense, this is what is weird," he mentioned.
Aside from that, the presence of Novanto's lawyer in the hearing was considered as not appropriate. In an ethic code hearing, the defendant should come alone without any lawyer present to provide genuine testimony.
Setnov was presenter in an ethical MKD hearing as the defendant of the inappropriate use of President Joko Widodo and Vice President Jusuf Kalla's name, as related to the extension of the working contract of PT Freeport Indonesia. Novanto was known to have met with the President Director of PT FI, Maroef Sjamsoeddin, three times.
The first meeting happened in the DPR Building not long after Maroef became the President Director of PT FI. At the time, Maroef intentionally met with the Speaker of the Parliament, Regional Representatives (DPD) and the People's Consultative Assembly (MPR). The second meeting was initiated by Setnov. At the time, Setnov introduced the oil businessman Riza Chalid to Maroef.
The talk continued as the three planned a third meeting. In this meeting, Maroef, who felt there was something off, had the initiative in recording the conversation at the Ritz Carlton Hotel in the SCBD area. The recording was conducted using Maroef's private cellphone.
The voices in the recording, which was believed to be those of Setnov, Riza and Maroef, have been an evidence and the breaking point of MKD to investigate the case of 'Papa Minta Saham'. Unfortunately, in the hearing last night, Setnov was reluctant to clarify or confirm the recording.
Meanwhile, the cellphone used to record the conversation is currently in the hands of the Attorney General, which have started to prey on the case. Maroef and Minister of Energy and Mineral Resources (ESDM) Sudirman Said, who become the complainant in MKD have been questioned by the Attorney General.
